1. Agreement
These Terms of Service (“Terms”) govern your access to advanced-artificial-mind.com (the “Site”) and, together with any written statement of work or contract you sign with us, the software engineering and related services (“Services”) provided by AAM Software (“AAM”, “we”, “us”). By using the Site or engaging the Services, you agree to these Terms. If you do not agree, do not use the Site or our Services.
2. The Services
We deliver professional software development and related technical services as described in proposals, statements of work, or other agreements. Specific deliverables, timelines, fees, and responsibilities are defined in those documents, which prevail if they conflict with these Terms.
3. Your obligations
You agree to:
- Provide accurate information and timely feedback, access, and materials we reasonably need;
- Comply with applicable laws and not use the Site or Services for unlawful purposes;
- Maintain the confidentiality of credentials we issue and notify us of any unauthorised use.
4. Intellectual property
Unless otherwise agreed in writing, ownership of deliverables and licence terms (including source code, designs, and documentation) are set out in your project agreement. AAM retains rights in its pre-existing tools, methods, and know-how. You grant us a licence to use your materials solely to perform the Services.
5. Fees and payment
Fees, invoicing, taxes, and payment terms are as stated in your agreement. Late payment may incur interest or suspension of work as permitted by law and the contract.
6. Confidentiality
Each party will protect the other’s confidential information with reasonable care and use it only for the purpose of the Services, subject to standard exceptions (for example information that becomes public through no fault of the receiving party).
7. Warranties and disclaimer
To the maximum extent permitted by law, the Site is provided “as is” without warranties of any kind except those that cannot be excluded by law. Any warranties for the Services are as set out in your written agreement.
8. Limitation of liability
To the extent permitted by applicable law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from these Terms or the Services, except where such exclusion is prohibited. Our aggregate liability arising from the Site (without a separate signed contract) is limited to one hundred US dollars (USD 100) or the equivalent. Liability under a signed services agreement follows that agreement.
9. Indemnity
You will defend and indemnify AAM against third-party claims arising from your materials, your instructions, or your misuse of the Services, except to the extent caused by our gross negligence or wilful misconduct.
10. Term and suspension
We may suspend or terminate access to the Site or Services where necessary for security, legal compliance, or breach of these Terms. Provisions that by nature should survive will survive termination.
11. Governing law
These Terms are governed by the laws of the State of Qatar, without regard to conflict-of-law principles. Courts in Doha, Qatar, have exclusive jurisdiction, subject to any mandatory rules that cannot be waived.
12. Privacy
Our processing of personal information is described in the Privacy Policy.
13. Changes
We may update these Terms from time to time. We will post the revised version on this page and update the “Last updated” date. Continued use of the Site after changes constitutes acceptance where permitted by law.
